Membership Terms and conditions
1.1 This page (together with all relevant site information/documentation) clearly explains the terms and conditions to be adhered to when we supply The London Experience Card. Once you receive a card you automatically become a member of the The London Experience Card (club). Further details regarding The London Experience Card can be found on our website www.thelondonexperiencecard.com. Please read these terms and conditions carefully and make sure that you understand them before ordering The London Experience Card from our site and automatically becoming a member of the club. Once you have ordered The London Experience Card, you agree to be bound by these terms and conditions.
1.2 You should print a copy of these terms and conditions for future reference.
1.4 We reserve the right to amend these terms and conditions at any time by giving you notice by way of posting the amended terms and conditions on our site. However, please note that you will be subject to the terms and conditions in force at the time that you ordered The London Experience Card from us; unless any change to these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you).
2. Information about us
2.1 This is an independent business and we operate our site. We are The London Experience Ltd, a company registered in England and Wales under company number 11189147 and with our registered office at Kemp House, 152 – 160 City Road, London, EC1V 2NX. Our main trading address is Kemp House, 152 – 160 City Road, London, EC1V 2NX.
3. Your status
3.1 By placing an order for The London Experience Card through our site, you warrant that you are legally aged 18 or over and capable of entering into binding contracts.
4. How the contract between you and us is formed
4.1 After placing an order for The London Experience Card, you will receive an email from us acknowledging that we have received your order subject to our confirmations for full acceptance. Your order constitutes an offer to us to receive a card and become a member of the club. All orders are subject to acceptance by us, and we will confirm such acceptance by sending you an email that confirms that The London Experience Card has been dispatched. The contract between us will only be formed when we send you a dispatch confirmation. Please Note: The London Experience Card offers great value for money therefore the year will commence from the date your order is processed and not the date you receive it. Estimated delivery time is up to ten working days.
4.2 The London Experience Card remains the property of the company at all times and may not be tampered with in any way.
5.1 The club operates as an ongoing subscription service so your membership is continuous and will be renewed automatically at the end of each membership period. We will send you an electronic reminder towards the end of your membership term to advise you regarding details of the new subscription; which may include a price increase. Your renewal date is the expiry date printed on your London Experience Card. We will not be held liable for any non-receipt of communication from us, including non-receipt of the renewal reminder. You are required to inform us if you change your correspondence address (both email and postal) or your bank card details. If you do not want to renew your membership you should contact us by emailing firstname.lastname@example.org at any point within your membership period, and no later than 5pm on the working day preceding the expiry date of your current London Experience Card membership. The automatic renewal does not apply to gift purchases. You will be subject to the terms and conditions as stated at the time of renewal. Please print from the website at the time of renewal.
5.2 You may purchase The London Experience Card as a gift for a third party. Third party cardholders will be bound by our terms and conditions. Should these be breached we will terminate the card.
6. Consumer rights
6.1 You have the right to cancel your initial registration of membership within 14 days of your original purchase. This does not apply to subsequent renewals or guest card purchase.
6.2 To cancel your membership, please email email@example.com. Upon cancellation you will receive a confirmation email; it is recommended that this is kept for your own personal records.
6.3 If you cancel your membership within the cooling off period you will be entitled to a refund of your membership, less an administration charge and pro-rata cost of £15. Refunds will be subject to the return of The London Experience Card, and any other items despatched as part of a promotion, within 14 days of your cancellation. You will also be responsible for the cost of returning your Card in an unused condition and in the original packaging; subject to any other statutory rights you may have. We do not provide refunds for any cancellations after the expiry of the cooling off period.
7. Availability and delivery
7.1 You will receive The London Experience Card and your membership documentation within 14 days of our confirmation of your acceptance as a member of the club; unless there are exceptional circumstances.
7.2 Once your order has been accepted we aim to despatch your Welcome Pack between 5 and 10 working days. If you do not receive your Welcome Pack within 14 days you must contact us ASAP, and within 20 days, to request a replacement. If you do not contact us within the 20 days any replacement card that is issued will carry a £12.00 administration fee and be re-issued with the original expiry date.
8. Price and payment
8.1 The price of The London Experience Card, which includes membership of the club, will be as quoted on our website at the time of application which may be at standard or special offer prices, usually subject to a promotional code.
8.2 The cost for a replacement card should you require one will be £12 and will be issued with the original expiry date.
8.3 Sales are currently exempt from VAT.
8.4 Prices are liable to change at any time, but such changes will not apply to orders that we have confirmed by email.
8.5 Payment will be done via PayPal or Stripe.
8.6 If you have opted for our monthly membership, payment will be taken monthly from the day you join.
8.7 Your monthly membership may not be cancelled or terminated by you during the minimum term (“12 months”)
8.8 If we are unable to obtain payment the first time The London Experience attempts to charge your payment bethod, The London Experience will:
8.8.1 Attempt to charge your pament repeatadly until payment in full is received; and
8.8.2 Notify you that payment has been unsuccessful by sending a notice to the e-mail address you have provided.
8.9 If any payment due is not received (or is reversed) at any time during the term of this agreement, the membership will be suspended.
8.10 If The London Experience us unable to successfully take payment from your payment method after 45 days, The London Experience with revoke your membership immediately.
8.11 If you membership is revoked in accordance with these Terms, your Memebrship will be permanetly deactivated and the card holder will no longer be eligible to receive any of the benefits of the membership.
8.12 If your membership pass is revoked in accordance with there terms, The London Experience will still be entitled to recover any unpaid membership fees from you.
8.13 Failure to use the Membership or your Membership benefits does not relieve you of responsibility for payment. In addition, regardless of the number of times a Membership is used, there are no refunds on amounts paid for any Membership
9. Participating Merchants and use of your London Experience Card
9.1 On presentation of The London Experience Card, participating merchants will honour their current offers as seen on our website however you will be required to clarify offer details before booking, which may be done via email or the phone. We advise checking percentage discounts, how many persons the offer applies to; card holder only offers, maximum family size or group numbers, the time of the offer (between 6pm-9pm for example), days of the week the offer applies or the maximum number of three for two’s at any one occasion. This is your responsibility as you will be required to pay the final bill. We work with trustworthy businesses who provide transparent offers and have confirmed that they have fulfilled their legal obligations. Please note: The London Experience Card cannot be held liable for any misunderstanding and you may be requested to show additional ID.
9.2 Merchants deals vary and some may only be valid for a limited time as merchants have the right to change their offers from time to time. Whilst they have agreed to update The London Experience Card, please refer to the individual merchants page as other exclusions may apply.
9.3 If a participating merchant has the words Pre-Booking is Required listed on its page on our site, advance bookings must be made by using the discount code provided or by calling the merchant directly and confirming the details requested as stated on your personal London Experience Card.
9.4 Offers advertised on our site are only available to members who present The London Experience Card. Such offers are not available in conjunction with any other offers that participating merchants may be running.
9.5 The expiry date of each London Experience Card will vary and will always be checked on your arrival by the merchant. Expired London Experience Cards are not accepted by participating merchants. The London Experience Cards and memberships are strictly non-transferable and can only be used by named members for authentic offers. Any attempted misuse of The London Experience Cards may result in confiscation.
9.6 We will use reasonable endeavours to update our site to show the particulars of participating merchants and the terms of their availability for participation in the club. Participating merchants may, however, be entitled to withdraw from the club or to change the terms and conditions of their availability after you have become a member. We shall not be held liable for any such withdrawals, changes in terms and conditions or availability of offers.
9.7 Members will benefit from any additional offers provided by merchants who join the club at anytime during their membership period.
9.8 Our printed marketing material is intended as a guide, referring to merchants who are participating at the time of publication. It may not be possible to include all participating merchants at any one time.
9.9 As a member of The London Experience Card Club you may enter competitions as advertised on our website and share photographs and posts on social media. All information shared publicly must not contain any nudity or abusive language that may cause offense to any individual or specific group.
9.10 We reserve the right to use photographs posted directly to our website or social media pages for marketing purposes. We will contact the person who posts directly to our site should we wish to use any given photo.
9.11 We reserve the right to quote any comments posted directly on our website and social media quoting the person’s first name. Full names will be used with permission.
9.12 As a company we respect the rights of individuals. Should any member post offensive material including nudity or any form of explicit/offensive language eg: swear words, racist/sexist/obscene personal comments, the post will be removed. The offender will be removed from the club and their card will be cancelled.
10. Our liability
10.1 if we fail to comply with these terms and conditions, we shall only be liable for the membership fee.
10.2 Subject to clause 10.3, we will not be liable for losses that result from our failure to comply with these terms and conditions that fall into the following categories:
10.2.1 loss of income or revenue;
10.2.2 loss of business;
10.2.3 loss of profits; or
10.2.4 loss of anticipated savings.
10.3 Nothing in this agreement excludes or limits our liability for:
10.3.1 death or personal injury caused by our negligence;
10.3.2 fraud or fraudulent misrepresentation;
10.3.3 any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; or
10.3.4 any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.
10.4 Any losses or liability arising out of, or in connection with, such merchant shall be the relevant participating merchants liability. We accept no liability for any bad experiences or at any of the participating merchants. We will not become involved in any dispute between you and any merchant.
10.5 We do not give any warranty for any goods or services accessed through, or displayed on, our site.
11. Written communication
11.1 Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
12.1 All notices given by you to us must be given to the Managing Director at info@thelondon experiencecard.com. We may give notice to you at either the email or postal address you provide to us when placing an order, or in any of the ways specified in clause 11 above. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an email is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an email, that such email was sent to the specified email address of the addressee.
13.1 Failure by us to enforce any of these terms and conditions will not prevent us from subsequently relying on, or enforcing, them.
14.1 If any court or competent authority decides that any of the provisions of these terms and conditions are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.
15. Third party rights
15.1 A person who is not party to these terms and conditions shall not have any rights under or in connection with it under the Contracts (Rights of Third Parties) Act 1999.
16. Entire agreement
16.1 These terms and conditions and any material expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of these terms and conditions. We each acknowledge that, in entering into these terms and conditions, neither of us relies on, or will have any remedies in respect of, any representation or warranty (whether made innocently or negligently) that is not set out in these terms and conditions or the documents referred to in them. Nothing in this clause limits or excludes any liability for fraud.
17. Law and jurisdiction
17.1 This agreement shall be interpreted in accordance with the English law and subject to the non-exclusive jurisdiction of the English Courts.
